What is a marriage license and do I need one to get married?


A marriage license is an official document issued by the government that must be obtained by the couple themselves. It cannot be acquired by a minister on behalf of the couple. The license serves as a legal recognition of the marriage ceremony. Following the wedding, both the couple and the minister sign the license, which must then be submitted to the issuing government office for official registration.


Conversely, a wedding certificate typically features an elegant, refined design and contains fewer details compared to a marriage license. Its primary purpose is decorative, serving as a memento for couples to celebrate their wedding day.



When should you obtain the license?


It's important to be aware that regulations concerning marriage licenses differ significantly depending on your location, and we will discuss this further during our initial meeting to help minimize any unnecessary stress. After obtaining the license, it is typically valid for a period of 30-90 days, with very little flexibility. The key factor to consider is timing – the license should not be acquired well in advance or shortly before the ceremony. Additionally, it must be promptly returned to the issuing office after the ceremony to prevent expiration.


Texas Wedding Law

Under Texas state law, couples must:

  • Wait at least 72 hours or three days between obtaining their marriage license and holding their wedding ceremony.

  • Marriage licenses in Texas remain valid for a period of 90 days.

  • License must be submitted to county clerk within 30 days of the ceremony.

Applicants must provide to the state clerk to procure a marriage license:

  • Verification that the couple isn’t already married or has divorced within the previous 30 days

  • Proof that the couple is not blood-related within second cousins

  • Documentation that neither applicant is delinquent on court-ordered payment of child support (which alone doesn’t automatically disqualify a couple from receiving a marriage license).


Newlywed couples aspiring to become Texans must personally confirm the accuracy of all provided details. It is considered a Class A misdemeanor in Texas to knowingly give false or misleading information.


Marriage licenses must be collected in person as the state does not offer a mailing service for them. Couples are required to present a valid and acceptable form of photo identification when picking up the license. Accepted forms of ID include: State driver’s license, Passport, Birth certificate, Military dependent identification, Pilot’s license, and Handgun license.


The price of a marriage license varies depending on the county where the application is submitted. Couples should budget for a fee ranging from $70 to $100. These licenses are accepted statewide.
